Member States must set effective, proportionate and dissuasive penalties for breaches of the AI Act and notify the Commission of them. The Act caps the main administrative fines: up to €35 million or 7% of worldwide annual turnover for breaching the prohibited-practice ban; up to €15 million or 3% for most other operator or notified-body breaches, including transparency duties; and up to €7.5 million or 1% for supplying incorrect or misleading information. Enforcement considers SMEs' viability.
